    Rose Law Firm is pleased to announce that Seth Hampton and Carla G. Spainhour have joined the firm as members. Seth focuses his practice on real estate, agriculture, commercial finance, renewable energy development, and environmental compliance. Seth is licensed in Arkansas, Louisiana, and Mississippi. He was recently recognized in the 2023 Edition of Best Lawyers: Ones to Watch in the areas of Banking and Finance Law, Environmental Law, Natural Resources Law, and Real Estate Law. Carla has an established practice focusing on taxation, estate and business and real estate transactions. Before joining Rose Law Firm, she spent the majority of her career as a partner in the tax section of another major Arkansas law firm, working both in Little Rock and Northwest Arkansas. Carla also owned her own CPA practice in Bentonville, which was formerly known as Daniels and Flynt, CPAs.     Yesterday, Rose Law Firm attorneys Brady Brown and Rebecca Roberts presented at the ACTEC Meeting of Arkansas Fellows. Brady's presentation covered trust decanting under Arkansas Code Annotated § 28-73-818 and Community Property Trusts. The presentation offered an overview of the mechanics, requirements, and tax consequences of trust decanting as those relate to the settlors, trustees, and beneficiaries.    Rebecca spoke about the SECURE 2.0 Act and its impact on estate planning clients. The SECURE 2.0 Act addresses the challenges in retirement planning and promotes increased savings and financial security for retirees.

    Rose Law Firm’s Dan Young and Michael McGill attended the The American College of Trust and Estate Counsel (ACTEC) Heart of Americas Fellows Institute this week in Omaha. Dan served as a co-program chair and his presentation provided a review of the common law on the payment of attorney fees by trustees, statutes on the reimbursement of expenses and payment of attorney fees and costs, and cases dealing with trustee’s attorney’s fees. The presentation also covered issues applicable to the exculpation of a trustee, limitations of actions against a trustee, and beneficiary consents, releases, and ratifications.
